BY ACCESSING OR USING THE SITE, YOU (the patient) AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT. Response to Electronic Communication - Dartmouth-Hitchcock will make its best effort to provide a timely response to electronic inquiries. In some cases, the clinic staff that needs to respond to an electronic inquiry or other communication may not be immediately available. Please allow at least 24 hours, except when the office is closed for weekends, holidays or inclement weather. Accordingly, emergency situations requiring immediate attention should not be submitted electronically. Furthermore, with respect to any electronic communications sent by the patient, we are only able to respond to such communications based on the information provided by the patient. If there is insufficient information provided, we will be unable to provide accurate and reliable services.
Web Links - myD-H may offer links to related medical websites not managed by Dartmouth-Hitchcock. These link(s) are for a patient's informational purposes only. Nothing contained in THE SITE is intended to be used for medical diagnosis or treatment. The information should not be considered complete, nor should it be relied on to suggest a course of treatment for a particular individual. Minor Eligibility - Under State and Federal law, there are certain types of medical information that the parent or guardian of a minor patient between the ages of 12 and 17 (inclusive) may not view without consent of the minor patient. Because of these requirements, when a minor patient reaches age 12, restrictions will be placed on myD-H access until he or she reaches age 18. The patient may also request a personal account.
Proxy Access - Individuals age 18 or older may request proxy access to another individual's myD-H account by submitting the Request for Proxy form electronically to Dartmouth-Hitchcock. Such access will only be granted to parties with parental rights or legal guardianship over the myD-H account holder, and only to the extent that the party requesting proxy access can demonstrate the legal right to the account holder's medical information. A myD-H account will be activated for both the proxy and the account holder. If the proxy's legal relationship with the account holder changes, the proxy must inform the clinic immediately by calling Dartmouth-Hitchcock Health Information Services at (603) 650-7110, or sending a written notice to:

Email Privacy - Patients who are users of myD-H should be aware that they will be notified via email when there is new medical information to be viewed on THIS SITE. This means that any person with access to a patient's email will be able to see this notification. Although no private medical information will be sent, the notification that new medical information is available by accessing myD-H may be information that a patient would not want others to know. Thus, patients should take this into account when providing an email address. Please know that if you send us an email, it may be shared with the Dartmouth-Hitchcock staff that assists the provider in providing the patient's medical care. A patient's confidential medical information on myD-H will be accessible only by appropriate clinical staff.
Security and Confidentiality - We afford the same degree of confidentiality to medical information stored on myD-H as is given to medical information stored by Dartmouth-Hitchcock in any other medium. Dartmouth-Hitchcock is committed to protecting the confidentiality of your medical information. We limit Dartmouth-Hitchcock employees' access and ability to enter or view information based upon their role in your care. Firewalls, passwords, encryption, and audit trails are further used to safeguard your information. We shall identify the records released and note the time and date of access each time a patient accesses myD-H. We have taken steps to make all information received from our online visitors as secure as possible against unauthorized access and use.
For other than general information viewing, myD-H must be accessed with a Secure Socket Layer (SSL) compatible browser or terminal (Netscape, Internet Explorer versions 5.0 or greater, Firefox or Safari). Our SSL web server uses authentication and offers the highest level of encryption technology commercially available (128-bit RC4). You can tell when you are secure by looking at the location (URL) field. If the URL begins with https:// (instead of http://), the document comes from a secure server. This means your data cannot be read or deciphered by unauthorized individuals. You can tell whether you are truly connected to Dartmouth-Hitchcock by viewing the digital certificate. This certificate verifies the connection between Dartmouth-Hitchcock server's public key and the server's identification.
User names and passwords provide two layers of authentication and are stored in an encrypted database that is isolated from the Internet. As a myD-H user, your role in maintaining the security of your medical information is: 1) Changing your password on a regular basis, and 2) Keeping your login ID and password confidential.
Limitation of Liability; Waiver; and Release - YOU AGREE THAT NEITHER WE, NOR OUR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTENT PROVIDERS OR SUPPLIERS SHALL HAVE ANY LIABILITY TO YOU UNDER ANY THEORY OF LIABILITY OR INDEMNITY IN CONNECTION WITH YOUR USE OF THE SITE. YOU HEREBY RELEASE AND FOREVER WAIVE ANY AND ALL CLAIMS YOU MAY HAVE AGAINST US, OUR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTENT PROVIDERS, CUSTOMERS, OR SUPPLIERS (INCLUDING BUT NOT LIMITED TO CLAIMS BASED UPON OUR NEGLIGENCE, OR THE NEGLIGENCE OF OUR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTENT PROVIDERS, CUSTOMERS OR SUPPLIERS) FOR LOSSES OR DAMAGES YOU SUSTAIN IN CONNECTION WITH YOUR USE OF THE SITE.
Indemnity - YOU AGREE TO INDEMNIFY, DEFEND AND HOLD HARMLESS US, OUR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTENT PROVIDERS, CUSTOMERS AND SUPPLIERS FROM AND AGAINST ALL LOSSES, EXPENSES, DAMAGES AND COSTS, INCLUDING REASONABLE ATTORNEY'S FEES, RESULTING FROM ANY VIOLATION OF THIS AGREEMENT OR ANY ACTIVITY RELATED TO YOUR ACCOUNT (INCLUDING INFRINGEMENT OF THIRD PARTIES' WORLDWIDE INTELLECTUAL PROPERTY RIGHTS OR NEGLIGENT OR WRONGFUL CONDUCT) BY YOU OR ANY OTHER PERSON ACCESSING THE SITE USING YOUR SERVICE ACCOUNT.
Third Party Beneficiary - The provisions of paragraphs (Waiver, Release and Limitation of Liability) and (Indemnification) are for the benefit of us and our officers, directors, employees, agents, licensors, suppliers, customers and Content Providers. Each of these individuals or entities shall have the right to assert and enforce those provisions directly against you on its own behalf.
